Terms and Conditions of Booking
By placing a booking for a short-term holiday rental with Cwm Mill Holiday Cottages (referred to as ‘Cwm Mill Holiday Cottages’, ‘us’ or ‘we’), the person making the booking and all other members of the holiday party (referred to as ‘the customer’, ‘guest(s)’, ‘you’ or ‘your’) are entering into a Contract with Cwm Mill Holiday Cottages in the following Terms and Conditions as set out below. The Contract will be governed by the Law of England and Wales and is subject to these Terms and Conditions. Your payment for your holiday will indicate your understanding and acceptance of these Terms and Conditions and that you agree to abide by them during your stay. A breach of the Terms and Conditions may result in your being refused admittance to the property or your booking being terminated, in which case your booking will be cancelled without refund.
Your Booking
Your booking is for a short-term holiday rental only, and you must not use the property for any purpose other than for a holiday during the holiday period you have booked, or for any other purpose or longer period. Sub-letting or assignation of the let is prohibited. Your booking for a short-term holiday at Cwm Mill Holiday Cottages does not constitute a landlord/tenant relationship between you and us, therefore you will have no entitlement to a new tenancy, or any assured shorthold or assured tenancy or any statutory protection under the Housing Act 1988 or other statutory security of tenure now or at the end of the holiday period you have booked.
The person making the booking (the Lead Guest) must be at least 18 years of age at the time of booking. You must provide us with the names and addresses of each member of your holiday group and the ages of any children. Under no circumstances may the maximum number of guests as outlined in the occupancy details on the website be exceeded. We reserve the right to refuse admittance if this condition is not observed. Where the person making the booking is different to the Lead Guest taking up the occupation, the person making the booking may be held responsible for cancellation, non-arrival and damages as set out below. Only the Lead Guest and the named holiday party are allowed to use the property and its facilities, any third party visitors are only allowed with our express permission and may visit during the day only. No parties, events or gatherings may take place at the properties. We are unable to accept bookings for stag parties or hen parties.
Booking Procedure and Payment
All accommodation fees are in pounds sterling (GBP) and must be paid in pounds sterling (GBP). To secure any booking we require a) your completed Booking Form provided by us and b) a deposit of 25% of the total cost of your booking to be paid in advance. We will confirm your booking in writing upon receipt of cleared funds. The balance of your holiday booking must be paid no later than 42 days before the start of your holiday. If your balance payment has not been received 42 days before your arrival date we will assume that you wish to cancel. If your booking is made within 42 days of your arrival date, payment will be due in full at the time of booking. No entry to properties will be allowed without payment, in full, being cleared beforehand.
Payments can be made by digital bank transfer, cheque or cash deposit. Any charges raised against us by our banks for handling dishonoured cheques, bank transfers or any other payments, must be reimbursed by the lead guest within 7 days of any request to do so. Deposits are only refundable under the Conditions set out below.
Our Properties
All our cottages include central heating, hot water, electricity (excluding electric vehicle charging – please see separate paragraph below) and Wi-fi in the cost of your stay. During autumn and winter months a starter supply of dried logs, kindling and firelighters are provided for use in the wood-burning stove. Bedlinen, towels, bath mats, tea-towels and oven gloves are all provided, together with washing up liquid, cloth, hand soap, toilet rolls, dishwasher tablets, detergent and basic cleaning products. We do not provide cot bedding so please bring your own if using our travel cot/s which are available at no extra cost. If staying for longer than 7 days we will offer you a weekly change of linen and towels free of charge. Additional changes of linen and towels during stays of less than 7 days can be provided on request at an appropriate extra charge.
On receipt of your final payment we will email you a welcome pack with directions, requirements for checking-in and further information on the cottage and local area to help you plan your stay.
Electric Vehicle Charging
Electric Vehicle charging using the cottage's electricity supply is strictly prohibited for safety reasons and because it will invalidate our Insurance. A Type 2 fast EV charger is available on site and guests can obtain access by paying a reasonable additional charge. If you would like to make use of the EV charger on site, please indicate this on the Booking Form.
Check-in & Check-out
Check-in is from 4pm on the day of your arrival. We would appreciate it if you could let us know your approximate arrival time either by phone, text or email. as we like to be here to welcome you and give you a brief tour of the property. If we are not present, you will find your keys in a key safe at the property so that you can let yourselves in and make yourselves comfortable. We will be available should you need anything. Earlier check-in may be available during quieter periods and should be arranged in advance of your arrival day. If you arrive early without prior arrangement, it is unlikely that you will be able to gain access to your cottage.
Check-out is by 11am at the latest. In quieter periods we like to offer a later check out if possible, but only by prior arrangement. Please leave your cottage as you found it, in a clean and tidy condition, with furniture and fittings in their original positions. Rubbish and recycling must be deposited in the appropriate bins outside.
Directions and arrival information
Shortly before your arrival we will email your directions, requirements for checking-in (including the code for the key safe) and further information on the cottage and local area to help you plan your stay.
Parking
Four parking spaces for River Cottage and two parking spaces for the Old Bake House are available on-site and free of charge. Additional parking may be available by prior arrangement. All cars are parked entirely at the owners’ risk.
No Smoking or Fireworks
Smoking of any tobacco products including, but not limited to cigarettes, pipes, e-cigarettes, e-liquids, cigars, snuff or chewing tobacco and vaping is strictly not allowed inside any of the properties. Fireworks and Chinese Lanterns or similar are prohibited as we are situated in a very rural area, surrounded by farmland and livestock.
Children
Children are always very welcome and we can provide high chairs and travel cots free of charge if booked in advance, subject to availability. We just ask that you bring your own cot linen/bedding. All equipment is used entirely at your own risk. Children must be supervised at all times whilst on the premises and particular care should be taken around water – in particular it should be noted that there is a river adjacent to the property.
Pets
We do not accept pets of any kind in our cottages.
Lost Property
Any lost property, if discovered and found, left behind by guests during a stay will be held for a period of 1 month. While we will make our best efforts to reunite lost property with its owners we accept no responsibility in replacing lost items and encourage guests to ensure they have all their belonging before checking-out. We may offer to post lost items via Royal Mail First Class postage at our own cost, otherwise collection can be arranged.
Wi-Fi
Wi-fi is provided for your reasonable use, and you agree to the reasonable and lawful use of this service.
Care of the property – your responsibilities as guests
You are responsible for the property during your stay and are expected to take all reasonable care of the property and its contents, in or on the property. They must be left in the same state or repair and in a reasonable clean and tidy condition. Any accidental damages must be reported as soon as possible in order to minimise damage and associated costs. Whilst we are prepared to cover the cost of replacing the occasional broken plate or glass, we reserve the right to charge for damages, including but not limited to breakages, spillages, stains, damage to furniture or fixtures and fittings. Problems with appliances, fittings and furniture must be reported immediately so that we can carry out repairs as soon as possible to minimise inconvenience to you and your holiday party.
You and members of your holiday party must not engage in, or allow, any activities or behaviour at the property that may cause disturbance, annoyance or nuisance to the occupiers or owners of neighbouring properties. As the owners of the properties at Cwm Mill Holiday Cottages, we reserve the right to request your holiday party to leave the property and cancel your booking without any refund if, in our opinion, the behaviour of any member of the holiday party is unreasonable or unacceptable.
Lost Keys
Lost keys will incur a replacement charge per key lost. We recommend that keys are kept in the key safe provided when leaving the property during your stay.
Amendments
Please contact us in writing if you need to amend your holiday before its commencement. We will do our very best to accommodate any changes you may wish to make but cannot guarantee that this will be possible. There is no charge for amending your booking.
Cancellation, Returned Deposit & Non-Arrival Conditions
Should you need to cancel a booking the Lead Guest must contact us as soon as possible and confirm cancellation in writing or by email. We will confirm your cancellation request once we receive it in writing. Deposits already paid are only returned in accordance with the following conditions;
If your cancellation occurs 42 days or more before the start of your holiday any accommodation fees paid will be refunded. If your cancellation is made less than 42 days before the start of your holiday you will be liable for the full rental amount and no refund will be due. However, we will make reasonable endeavours to re-let the property and if successful we will refund the total amount you paid for your booking less a 10% administration fee and the difference in price between your booking and the replacement booking, if one is made. If applicable, this will be refunded within 14 days of your original check-in date.
If you, or any member of your intended holiday party, is unable or disinclined to travel to or stay at Cwm Mill Holiday Cottages for any reason including but not limited to illness (including Covid), a requirement or recommendation to self-isolate or quarantine, shielding, a call to jury duty, military service, incarceration, change in personal or work circumstances, family emergencies, travel delays, vehicle breakdown, and delays with public transport, there will be no right to cancel or to receive a refund unless we re-let the property, other than according to the conditions above. These events remain at your risk and you are strongly recommended to take out UK travel insurance to cover such eventualities. Covid is also now a known risk and it is possible for you to insure your holiday against it. This can include the customer or any of the party having Covid, the customer or any of the party having to isolate or quarantine, or you wishing to shield any members of the party. If you choose not to take out UK travel insurance, then you accept responsibility for any loss that you may incur due to your cancellation.
If you have to leave your holiday cottage earlier than your expected check-out date no refunds will be made. If you have not arrived at your property by 12pm the day after your holiday start date, and you have not advised us that you will be late, we will deem the holiday to have been cancelled and no refund of any monies paid will be made. We strongly urge our customers to take out cancellation insurance to protect against any potential losses.
If your booking has to be cancelled because Cwm Mill Holiday Cottages has to close through Force Majeure, meaning any of the following circumstances which may hinder or prevent the performance by us of the Contract, including but not limited to: (a) acts of God, flood, drought, earthquake or other natural disaster; (b) epidemic or pandemic; (c) terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations; (d) nuclear, chemical or biological contamination or sonic boom; (e) any law or any action taken by a government or public authority, including without limitation imposing a restriction, prohibition, or failing to grant a necessary licence or consent; (f) collapse of buildings, fire, explosion or accident; (g) non-performance by our suppliers or contractors; and (i) failure of utility service, and the period of closure covers your booking you will be refunded in full. In the rare event we need to cancel your booking with us, please be aware that we cannot be held liable for circumstances beyond our control and that our liability to you is limited to the refund of any payment already made.
If we have to end your holiday early due to forces beyond our control we will refund the appropriate proportion of the booking cost. In these circumstances our liability will not extend beyond this and there will be no compensation or expenses paid.
Our Liability
The use of the property and amenities at Cwm Mill Holiday Cottages, and guests’ own property, are entirely at the users’ risk and the owners can accept no responsibility for injury, death, loss or damage unless arising from negligence on our part. We make every effort to list our property in an accurate manner however, due to a programme of continuing refurbishment, some fixtures and fittings may differ to those in the photographs. We very much hope you enjoy your holiday with us but in the hopefully unlikely event of a problem or complaint we ask that you notify us during your stay so that we may resolve the problem. Any complaints made retrospectively cannot be considered.
Access
We reserve the right to enter the property at any reasonable time to carry out repairs and necessary maintenance. We will endeavour to agree a convenient time in advance but at times it may be necessary to enter the property without prior arrangement.
Your Personal Details & Privacy
We take all reasonable steps to ensure the security of your personal data. We will never pass on or sell your details to any other party. If we include your details on aur mailing list, it will be purely to mail you about Cwm Mill Holiday Cottages and your details will be deleted on request.
